If the video was made by grassroots supporters and not paid for by Rand Paul then it could probably be considered fair use, particularly if credits were given to the band some where in the video. Certainly they can’t hold the campaign responsible for grassroots efforts that they did not endorse or condone.

It’s not “just a copyright issue.” If Mr. Paul wants to be a lawmaker, he has to obey the law; ditto if he wants people to respect the rights of private property.
