Is the President above the law?

Most of the news stories about the Meet the Press debate Sunday on President George W. Bush's domestic spying program centers on comments that both Democrats and Republicans now feel the program is useless because al Qaeda knows the NSA is listening and they won't use cell phones to discuss their plans.

But that's not the real story that came out of the Sunday's political circle jerk. The real story is that Pat Roberts, the arrogant Republican chairman of the Senate Intelligence Committee, told show host Tim Russert that he believes the President of the United States is above the law and can do whatever he damn well pleases.

Roberts, a staunch defender of Bush's right to spy on who he wants, whenever he wants and however he wants, told Russert that Bush can, and should, ignore the law when he feels it is in the best interest of national security.

That prompted Russert to ask:

"Senator Roberts, let me ask you a very serious question. Do you believe that the Constitution gives the President of the United States the authority to do anything he believes is necessary to protect the country?"

To which Roberts replied: "Yes."
 
Roberts later said he believed the President's authority was "above laws passed by Congress."  In other words, George W. Bush is a dictator with absolute authority and no one, not the law and certainly not Congress, has the power to question or override that authority.

Stop for a second and think about this. The Senate Intelligence Committee, and its counterpart in the House, are the only Congressional bodies that are told -- and in most cases only in part -- what the White House is up to when it comes to spying on Americans, ripping the Constitution to shreds or trampling on the rights of this nation's citizens. And the chairman of the Senate Intelligence Committee believes the President has absolute power to do whatever he pleases with no Congressional oversight.

That smoke you smell is the Bill of Rights of the Constitution going up in flames. That pounding you may soon hear on your door is George W. Bush's Gestapo, the so-called Department of Homeland Security, demanding your papers and hauling you away because you dared speak out about der Fuhrer's policies.

If the rubber-stampers who are supposed to run things in Congress believe Bush is all powerful and his actions beyond reproach then America as a free nation ceased to exist the day these madmen took control of our government.

Roberts, like the other lemmings who appeared with him on Sunday, believes Bush's spying program is useless now not because it was illegal and questionable in value. He and other blame the press for making the program public.

In other words, we're the terrorists who threaten the absolute rule of their President, the man Roberts says is above the law.

As one of those who broke the story about Bush using the government to spy on Americans, I sincerely hope I did my part in undermining the program. And, until Dubya's goose-stepping goons haul me away I will continue to do whatever I can to undermine Bush's actions and authority.

Why? Because I'm an American -- or at least I was when there was still an America left to defend.

It is not the enemy from without that will destroy this nation. Our demise will come from within and this is quite evident. "Above the law", that is the opinion of the religious and far right and my honest concern is how can a free nation allow this to happen?

I saw the exact prgram Doug referred to in the RANT. Russert was good but was completely frustrated by what I too saw as a VERY ARROGANT Pat Roberts.

He was using the same exact excuses as BUSH does. We live in a different time, a different era, under a different threat, etc etc etc. ALL THE WHILE never giving 5 seconds to the EXISTING LAW which is what the discussion was supposedly all about.

The only thing I didn't hear was that CLINTON did it so it must be OK.

It is refreshing to see a spade called a spade, especially since our media has decided that it is far more important to report on some skater's groin injury. (Not that her groin isn't attractive, mind you.)
I wonder just how long Sen. Roberts would maintain this pretty fiction should the presidency change hands. I suspect that the shake of a ewe's tail would shift positions far more slowly.

Roberts either forgets, ignores and is incapable of understanding three important points.
Everyone, including our dry drunk president, is beholden to and must follow the US Constitution.
With no oversight, congressional or senatorial, such ultimate, unrestrained power easily gets out of control. Federal critters which gain new powers rarely or never give them up.
By deliberately refusing to fulfill his own mandate and oath to restrict unbridled executive or judicial power. Roberts is a traitor to the United States of America.

This is indeed a sad day for our country. Luckily, we have people like Doug taking the lead and spreading the warning.

Doesn't anybody get it? Bush is above the law as long as he has a majority in the House and Senate. They aren't going to lift a finger to do anything to stop him.The inaction of our elected officials is so stunning that it makes me breathless. Will someone get a cattle prod and see if I'm still alive and capable of movement? Isn't this the way Nazi Germany started?

First they wiretapped the cell phones, but I only use it to call my husband in an emergency, so I didn't speak up.
Then they wiretapped residential phones, but I mostly use it to innocently chat with friends, so I didn't speak up.
Then they created no fly lists of questionable accuracy, but I don't fly, so I didn't speak up.
Then they confiscated library records, but I don't use the library much, so I didn't speak up.
Then they repealed the First Amendment and took away my right to free speech, and I had no way to speak up.

I think I have the solution America needs. Let Iran sell oil in euros like what Saddam was doing before bush waged war against this practice. We can still make the dollar strong because we have something much more marketable than oil right under our noses.America has a political regime that is hated by 99% of the world population. Now lets think about this for a second, 6 billion people who would jump for joy and dance in the streets all day long if they heard bush and cheney were dead or in jail. Now some say this sounds overinflated, but it isnt. So how can we turn these lemons in our government into lemonade, an intelligent person might ponder?I say use their inhumane laws against the bush regime, arrest the bush admin as enemy combatants, they fit the definition. Then we could produce a pay-per-view torture series to run for the next 25 years. If only 5% of the world population watched and paid this would run close to 5 trillion alone annually in revenues for repartation to the treasury they robbed.The real money could come from lottery sales for the chance to win a trip to America to torture these combatants on ppv series. I foresee a 20 trillion annual boon to the American treasury from this annually.It wouldnt have to be the inhumane torture that cheney subscribes too, it could be humane things like rubbing their noses in dog doodoo or throwing pies and rotten vegetables at them anything to humiliate them without real danger to these potential cashcows we have under contract.Ludicrous some may say, i say its sweet justice and considering that the usa takes in a little less than 3 trillion annually in government generated revenues, the staggering potential of this idea is limitless. So if bush and cheney reallly loved America they would volunteer for this.

I watched Russert yesterday too. I wonder how supportive Senator Roberts will be of all encompassing Presidential powers when that President is Hillary!!! Actually, I don't think she can win, but... we certainly have to do something to wrench control of our once great country from these madmen!

About three or four years ago I turned to my husband and said, "He's in for eight years 'cause he's got Americans so afraid of repeated attacks "we" will see Bushrovecheneyski as the Saviors and, mark my words, the cabal has come home to roost. We won't see another legitimately elected president in our time. It's the beginning of overt fascism. Most Americans won't care as they swill beer, can still afford WalMart and stay sated on TV."

It's any dictator who can control his country, and then sets his sights on dominating the world. We become our enemies, all too readily. Mere pieces of paper (Constitution, Bill of Rights) are all there is between us and spiraling into chaos.

Has anyone asked lately for the definition of Terrorist... or enemy of the state? I think its time to define in black and white words on paper who this enemy is.
Personally everytime I heard ButcherCo say "the enemy"... I feel like he is talking about me and you.....
Now "the enemy" substitute... me and you... knows how this spy program works.....

Has Pat Roberts read the Constitution? Should we rename the SIC the Senate Lack Of Intelligence Committee? How these simple minded morons got into positions of power is beyond my comprehension. We truly must find find people with more intelligence and a wider viewpoint for election to office. Of course, as it stands now, people with intelligence tend to shy away from elective government positions. Damn shame. Thanks Doug for all your great work.

Bush, while admittedly an idiot, is constrained within the confines of a policy nexus that traces its roots to the Balfour Declaration and thus to Austrian journalist Theodore Herzel's book. Those who are not familiar with the facts can use a google search.

Having been born in 1941, I have always wondered what it was about the German pre-war period that led ordinary people to approve - or at least not speak out against - the gathering of dictatorial powers by Hitler and his henchmen. Today's talking heads and craven politicians explain it all.

Speaking as a moderately conservative (Sorry, Rush.) Republican who never voted for Bill Clinton, I am ashamed of my party, and I intend to join the Democratic party immediately after I vote, in the primary, against Rick Santorum.

Thanks for speaking out and I will continue to speak out too as we all should. The more of us who continue to speak out, the more chance we will turn the tide before the Bush Gestapo hauls us away. I think our speaking out and predicting what horrible things Bush will do to stay in power has prevented him from carrying out some scenerios. Not only should we continue to speak out on what he is doing, we should continue to predict what he might do and spread it everywhere. Our only tool of prevention at this point is to make the public aware of what he could be possible of. Make the worst scererio so obvious that they don't try it.

They’ve been aided and abetted by a conspiratorial group of self serving morons who have the audacity to call themselves Congressmen and Senators of the United States of America. Silk suited imitators of real Americans who conduct comedy skits with looks of grave concern as if there is some issue about the president’s warrantless wiretaps by the NSA when there isn’t one. The president has confessed to practices that are unconstitutional; actions for which he can’t blame low-ranking, ill-trained zealots. This is personal. It’s about George W. Bush and the law and no amount of official committee posturing can turn it into an “issue” to be decided upon
When Bush claimed his wiretapping was legal because congress gave him the authority, blah,blah, blah, I laughed out loud because I’ve read the Constitution. I find it comical that the argument ensues among the members of Congress as to whether Bush has, or was given, the right to violate the Fourth Amendment. No one has that right and every member of Congress knows that.
Bush did NOT swear an oath to protect and defend America, although some such duty is implied in Article II, which, also, makes him commander in chief of the armed forces. Therefore, the idea that this entails authority to order wiretaps on civilians collapses on itself. Article II does not make him “commander in chief” of American civilians. Whatever authority the Article confers is strictly military and the Constitution further provides that the military has no jurisdiction over civilians.
Whatever civil power to protect does exist, is set forth within the limits of the Constitution and regarding wiretaps, we must turn to the Fourth Amendment. It doesn’t say that people’s right to be secure in their homes and “effects” may be violated only by Congress or only by the judiciary or only by the president. It says that the right “shall not be violated” period. It doesn’t say that Congress shall issue no warrants without probable cause, or the judiciary shall not issue such warrants, or the president shall not issue them. It says “no Warrants shall issue” in violation of the conditions that immediately follow.
The president, having routinely ignored the Fourth Amendment rights of a host of victims, insists that the amendment doesn’t apply to him because of an invisible grant of discretion hiding in Article II. He invokes some heretofore undetected constitutional immunity to the Constitution, and asserts that the unwritten trumps the written. He includes another pious but pointless defense: that nobody bugged communications in which both parties were on U.S. soil. But that raises the obvious question: If he is ignoring the Fourth Amendment, what difference does it make where one of the suspects plants his feet?
Go back to the oath Bush DID take, twice. In it he promised (as required by Article II) to “preserve, protect and defend the constitution of the United States.” He did not swear that he would preserve, protect and defend only select parts of it. Why then, are members of Congress bothering to discuss the FISA law that created a secret court to expedite urgent requests for warrants and even provides for issuance of a warrant after the deed has been done. Federal laws don’t trump the Constitution. Without question, Congress has power to create “inferior” courts. But they cannot create one with power to waive a part of the Constitution. To do that, they would have to amend the Constitution. And, that renders absurd the question so many members of Congress have asked, “Why didn’t Bush come to them and ask them to authorize the wiretapping?”
President Bush and every member of Congress knows that there is no issue to be argued or discussed. The warrantless wiretapping the president ordered was and is unlawful and he can’t blame it on anyone else. There’s no one he can sacrifice, no aide or faithful secretary to fall on his sword. There is no law nor authority assumed or granted allowing him to violate his oath and break the law. Congress has no alternative but to impeach Mr. Bush and remove him from office and they know it. President Bush knows it. Should Congress fail to live up to their responsibility, the citizens must remove this Congress and install one that will obey the Constitution of the United States of America. Otherwise, America will be right back where we started and the Constitution will be thrown out with the morning trash - All Hail King George II.

All I can say is that when the bastids (as we say in Massachusetts) break my door down, come to drag me away, they damned well better bring tape for my mouth.
I am a proud American who wears her "visit" from the Secret Service as a badge of honor. They, the SS, asked me how I "felt" about Bush. This was 2001 so I said, "If you're askin' me if I voted for him the answer is no. But in that regard, sir, I am in the majority so I will give you that." They took handwriting samples and photos, of myself and my belongings. Somewhere in Washington DC, they have my photo, looking pissed off, bed head, bathrobe and all. And that makes me very proud. As does accessing your RANT every morning. It makes me proud Doug, proud that this whole frigging country hasn't turned into a bunch of pod people. I can see them pointing and screaming now, pointing and screaming at Cindy Sheehan...

In Jan. 1933 Hitler went to Hindenburg and in their discussion indicated he was the right man and would do everything to protect the country and get it moving again. An old man gave in, and as a result, I.......born in WWII Germany, lost everything my family owned and some of us our lives. Today, the old man is Congress and definitely the weary, worn-out Democrats that don't seem to care, and we are turning a blind eye towards the same danger as in 1933. All of us. We need to wake up now, or it will be too late. Pleeeeease don't let my adopted country go the same way Germany did. (I am a USAF veteran too, so I served the USA well!!).

I'm amazed how you people carry on with one another that you must defend your freedoms even if it means less morals. Freedom? What freedom? You lost your freedoms in 1913 the moment President Wilson signed in the Federal Reserve. Years later , he spoke about it using words like, "I have destroyed my country." Former JFK's wife Jackie, re-married a powerful man after her husband and brother-in-law's assassinations, not for wealth and name but for protection. Even her late son was a threat to those who hate the truth, and so he is no more. Jeff Gannon, the Kennedy's, Pearl Harbour, controlled stock market crashes , the former building 7 in New York are hints for a people on the most part are turning in greater numbers toward disbelief and unacceptance of the evidences that speak for themselves but also too many folk's are just what the program order'd, totally clueless. America's freedom is a fraud now and your blind justice is falling apart faster than chunks of marble landing on it's very steps under the words EQUAL JUSTICE UN-DER LAW. Bush's father spoke of the "new world order" and his beloved son is going to dictate not only to American's but the world over and will wave off with a crafty nazi style hand fluttering, any walls in his way to carry out that very order. As reported on NPR this weekend, the program is esstenially useless since they currently have over 8000 hours of phone calls that have yet to be listened to much less interpreted as they are in foreign languages.

By the comments of Sen. Roberts, Bill Clinton should be cleared of any wrong doing, because he would also be above the law. I can't believe that guy said that. It should be obvious that they are not going to the FISA court to get warrants because they are using the NSA to spy on political opponents and anybody who would disagree with them. Otherwise, why wouldn't they get the proper warrants and disclose to select members of congress who it is they are spying on? This whole bit about wiretapping al Queda is just a smokescreen.

It is terrifying me the more I learn about what Bush et al are doing. I have written 12-15 letters to him which are always copied to my congressional delegation. I have had one nonsensical answer from the pres. Various ones of the congressional delegation have responded. The Republicans give me pablum. The Democrats agree with me but are stymied by the numbers in Congress.
My letters seem to be way ahead of anything reported as results in the media or literary references: 1984, etc., and how about The Rise and Fall of the Roman Empire (especially the fall). My letter about Iraq fighting back was too late. He had already made up his mind and was just manipulating Congress to approve.
At this point, he is the terrorist terrifying me. His next blunder will be making war on Iran. Will we go along with his blunder. It doesn't matter, does it. He can do whatever he wants.

Instead of people wringing their hands about the coming police state, why doesn't everybody remember that this is a nation of 290,000,000 people, and that the only way that this band of murdering thugs can impose a police state on us is if poltroons and idiots stand there and let it happen? How many armed individuals, many ex-military, are there in this country, anyway? Frankly, if the people in this country had a collective spine, they would have done a remake (they're popular these days, you know) of The American Revolution by now, and these people would all be worm food. The fact that these people are all still walking, and doing what they do, is proof positive that this is a nation of sheep.

As far as Iraq goes, how about another remake? We could call this one Fragging for Dummies.

When folks predicted that this would come to pass because a group of fascists had taken control of both Washington and the GOP, the words "kinspeerisee theerie" were trotted out and we were called paranoids.
It's too late, too many have had a long drink of the Kool-Aid and the rest are too chickenshit to do anything about it and are hoping they can still watch "The Batchelor".
We got what we deserved and the only tragedy is that our kids will inherit this terrific nightmare.

All Americans should know this: Bush came into power with an agenda--to suppress and ultimately eradicate the middle class and Constitution. He and certain traitors and fascists in his party (not everyone, mind you--some are true Conservatives) are guilty of forethought with malice in their treasonous actions. This in principle is NO different than what happened in Hitler's Germany. Of course Bush is NOT Hitler and the circumstances and such are different; however know this: His intentions from the beginning were to overthrow the Constitution and Bill of Rights and the Middle Class in this country. He didn't just walk into this unknowingly or it isn't just happening because of incompetence or some other reason (that is their handy excuse). It was rather premediated and planned to a high degree and with great efficiency over many years, including the use of covert operations, propaganda, fear, agent provocatuers, and well placed 'agents' in positions of power. In short, this is a CIA type action turned inward against Americans! What for years was used in other countries to influence, undermine and overthrow legitimate regimes, IS NOW BEING USED ON US! Wake up folks!!

If ever there has been a display of how the American voting public can be led and convinced by empty statements of "patriotic/freedom" rhetoric (what the hell is patriotic about the Patriot Act?), the last 5+ years have proven it. For those people for whom history still has some significance, compare the last five years with German history circa 1936 to 1939. That was another period of time where liberals were condemned, nationalism/economics were justifications for invading another sovereign country, and the government was granted powers to disrupt and suspend human rights to privacy and well-being. Too similar to our contemporary moment, there was a core of intense and zealous "patriotism" which equated to condemnation of any political stance outside that of the nationalistic/conservative right wing, and a political/economic agenda that rationalized the invasions of Czechoslovakia and Poland by suggesting that those "evil neighboring countries" were plotting the demise of Nazi Germany. Poland, particularly, was trumped up as preparing for war and thus Germany was vindicated by invading first (Iraq, anyone?).
The arrogance and self-rightiousness of this current administration is too frighteningly similar to that of the most horrific this world has ever experienced. We don't learn from history, as recent as it was. Hopefully someday we will awaken and realize how far this nation is from it's designers' intentions. Subscription to extremism or cults of personality can contribute to building a bridge to tyranny. Inflexible perspectives and an arrogant presumption of moral exclusivity - too often associated with conservative extremism - can quickly lead to Naziism or Fascism. This country deserves better, and only exists now for our ungrateful benefit because our ancestors were cautious about damaging our platforms of freedom and human rights. That's certainly not occurring in the current administration - in fact, what's happening should be scaring us out of our apathy.

I'm originally from Pat Robert's home town in Kansas. He's not the brightest stick in the bunch, and word around town is that he is getting filty rich off of the Republicans. When he first ran, he used a phony mailbox address since he didn't actually live in the area he was hoping to represent.I also watched him remain silent to save his own but when an unfair accusation and lie was fabricated about a colleague. He is, in every sense of the word, a lemming who doesn't understand the very fundamental values of our Constitution, and worse than that, he doesn't have the intelligence to make wise decisions when the terrorists do decide to act here again. Roberts isn't the only ignorant citizen! I teach at a reputable private university and every semester, I ask my students who was responsible for the 9/11 attack. Nearly every student still says "Iraq." After I ask them that question, I ask them to briefly explain the balance of power set forth in our Constitution. One in thirty knows at least a little something about it. After providing them with the answers, I then ask them to write essays that ask, "Why is it important to know this information?" With an uneducated populace, the New-Cons will do whatever they want, and they will get away with it! As a Democrat from Kansas, I've had to learn to defend my positions my whole life. I've seen idiots like Roberts run on "America-God-Apple Pie" platforms while the Republicans use his ignorance and that of others to stab Democracy in the back for corporate gain. In my home town, like so many, I've watched Mom-and-Pop stores give way to Walmart. I've seen the demise of the family farm. I've seen at least a half-dozen neighbors die prematurely from brain tumors presumably from the high nitrates in the water (due to the dumping of cattle paunch.)Sadly, nothing can be done because the Republicans have managed to downsize all of the watchdog agencies. It's a sweet deal they've been planning for decades, and unless we wise up, it will only get worse. I research for a progressive news program called libertynewstv.com. (On line, on cable access, featured on LINK and Free Speach TV) It isn't easy for any of us who work there to provide the time needed to put this monthly program together, but, if in some small way, we can wake a few Americans up, it will have been worth it. Thanks, Doug, you are truly a voice in the wilderness of beautiful Floyd County. (Ironically, I have family there too!) I've seen my hometown in Kansas fall prey to corporate meat packing plants, and I cry when I go home and see how they've destroyed what was once a beautiful town. Pat Roberts and his filthy associates have ruined it with their corporate objectives (As they destroy the environment and increase the need for schools and jails, they enjoy a full tax abatement in the name of "economic development.") If each one were to work at sharing this program through a chain letter principal, your following could increase very rapidly, and unless it does, you will find November has come and gone, with little change.

Consider, chain letters are not illegal unless the people participating are sending money through the mail. There is nothing illegal about asking people to view the views of others. Most sane people should fear for their own safty.

Well said Doug Thompson! As a kid growing up I had to listen to people talk about how stupid the germans were for allowing the 3rd reich to rule their country. Well my great-granddad opposed that regime and was put in prison for one year under suspicion of being a socialist, then released due to lack of evidence.(my mom is german) One day the police came and searched the family apartment for socialist literature which my great grandmother had just thrown in the neighbors open window, then they took great-granddad away. This country is now apparently on a similar path.After the war was over the americans apparently allowed only one book to be burned: The Secrets of the Federal Reserve by Eustace Mullins.

I think all the comments are correct. We have no one to blame but ourselves. The House of Representatives told us in 1994 it was either their way or they would shut the government down and they did, till the senate wouldn't go along with them. They then managed to get control of both houses and the presidency so now it is a dictatorship. Again we have no one but ourselves to blame.

As an American living abroad (since 1988), my first sence of leaving the USA was at the perspective change. Looking back at the fishbowl of my youth, the lack of sensitivety and understanding at home of the worlds perspective on the USA has always been indeed frightening. Since 9/11, the fear driven paralysis of believers in constitutional law and historic propriety from both sides of the US political spectrum have been frightening.
Now that the emporer has crossed over into complete loss of judgement, perhaps the pendulum has begun to turn and the healthy US democratic system can indeed heal itself and return to a semblance of progressive evolution for the forces of good. So much damage has been done.

I would like to know exactly what is illegal about wire tapping suspected terrorists? If anything, it gives the so called Goose-steppers an upper-hand in defending this country. I don't see American citizens being hauled off to Cuba. I do see the terrorists scrambling to find other ways to communicate to carry out their sick Jihad. If any American citizen is helping to kill our fellow citizens, we have a right to know how they are doing so. Show me what has been done illegally and I will be happy to research for myself. GO BUSH.
